You’re not alone — and you still have options.Under Japan’s immigration law, overstayers may face detention, deportation, and a re-entry ban of at least five years. This can be frightening, but there are legal ways to move forward depending on your situation. One option is the Departure Order System, which allows certain individuals to leave Japan voluntarily without being taken into detention. This is designed for people who turn themselves in to immigration authorities and meet specific requirements. Another possibility is applying for Special Permission to Stay, which may allow you to remain in Japan legally if you have strong personal circumstances, such as family ties, long-term residence, or humanitarian reasons. Each case is different, so it’s important to speak with a legal professional or immigration advisor to understand your options. You don’t have to face this situation alone — support is available.
Departure Order System
Foreign nationals who remain in Japan after the expiration of their period of stay and whish to their home countries are allowed to leave Japan without custody, and the "reentry prohibited period" shall be one year.
Requirements
- Who voluntarily appeared at a regional immigration bureau declearing to leave Japan as soon as possible.
- The infraction does not correspond to the category of "Deportation" except overstaying.
- Who have not been sentenced to imprisonment after entry into Japan.
- Who have neither deported from Japan nor left Japan under "Departure Order System" in the past.
- Who can be expected to leave Japan as soon as possible.
Although foreign nationals did not meet the all requirments mentioned above, if they voluntarily appeared at a regional immigration bureau, may go through procedures without custody by obtaining permission of provisional release.
Special Permission to Stay in Japan
Foreing nationals who wish to remain in Japan must
appear first at a regional immigration bureau, declear the charges
and state the reasons why they require to continue living in Japan.
Special permission to stay in Japan is considered in making a decision
on whether to be granted or not taking into account all relevant
circumstances such as their marital status, member of their family,
age of their children etc.

We go along with you
We accompany foreign nationals who intend to appear
at a regional immigration bureau and support for procedures under
either "Departure Order System" or "Special Permission to Stay in
Japan". Although he/she become under custody, we will also apply
for "Permission of Provisional Release.
Foreign nationals who left Japan under "Departure Order System" will
be supported by us in application for reentry into Japan after the
reentry prohibited period.
